On January 27, 2022, Prosecutor Timothy J. Rutkowski charged Luther Gabriel Dinsmoore, of Akron, MI, with one felony count of Home Invasion 3rd Degree and one misdemeanor count of Assault & Battery based upon an investigation by the Huron County Sheriff’s Department indicating that Dinsmoore had forced entry into his ex-girlfriend’s apartment in Fairhaven Township and assaulted another individual inside the apartment.
A Preliminary Examination was held in the 73-B District Court of Huron County before the Hon. David B. Herrington. At that time, the People requested that Dinsmoore be bound over to the 52nd Circuit Court on a felony charge of Home Invasion 1st Degree along with the misdemeanor count of Assault and Battery. That motion was granted by the Court.
While awaiting trial, Dinsmoore sent two letters to his ex-girlfriend from the Huron County Jail that were ultimately turned over to Dinsmoore’s parole agent. In these letters, Dinsmoore urged his ex-girlfriend to testify untruthfully at the Preliminary Examination. Prosecutor Rutkowski subsequently charged Dinsmoore with Witness Intimidation/Interfering with a Criminal Case. A Preliminary Examination on those counts was held in the 73-B District Court and Dinsmoore was bound over on both counts to the 52nd Circuit Court.
A jury trial was held on the Home Invasion 1st Degree case starting on July 12, 2022, in the 52nd Circuit Court tried by Prosecutor Rutkowski and Assistant Prosecuting Attorney Alexander Pahany. The People presented their entire case and Dinsmoore testified on his own behalf. The trial was completed on that day with closing arguments and jury instructions to continue on July 13, 2022. That morning, Dinsmoore opted to plead guilty to one count of Home Invasion 1stDegree with an enhancement for being a habitual felony offender as well as one count of Witness Intimidation/Interfering with a Criminal Case to resolve both of his case files.
Sentencing is set for September 19, 2022, before the Hon. Gerald M. Prill.
